What Is Trademark Registration

Trademark registration is the legal procedure for obtaining the exclusive right to use a trademark. A natural person, legal person, or other organization that needs to obtain the exclusive right to use a trademark for its goods or services in production and business activities shall apply for trademark registration. A trademark registered upon approval is a registered trademark. The trademark registrant enjoys the exclusive right to use the trademark, protected by law. The exclusive right is limited to the approved registered trademark and the approved goods or services. Registered trademarks include goods trademarks, service trademarks, collective trademarks, and certification trademarks. Goods for which the use of a registered trademark is required by laws or administrative regulations must apply for trademark registration; those not approved for registration may not be sold on the market.

Trademark registration is the prerequisite and condition for a trademark user to obtain the exclusive right to use a trademark; only trademarks registered upon approval are protected by law. The principles of trademark registration are the basic criteria for determining exclusive trademark rights, and the choice among different registration principles results from legislators in each country weighing the relationship between legal certainty and legal fairness on this issue.
